ONU X RÚSSIA: UM POR TODOS E TODOS POR UM!
O SURGIMENTO, NO SECULO XXI, DE UMA ISONOMIA ABSOLUTA ENTRE OS ESTADOS NACIONAIS!
Hoje o representante da OTAN ( NATO) Jens Stoltenberg, citando Alexandre Dumas na sua obra Os Três Mosqueteiros, dizendo ” Um por Todos e Todos por Um” , caracterizando a reciprocidade solidária e monolítica do bloco da Aliança do Atlântico antecipa, da mesma forma uma mudança paradigmática no núcleo duro, no cerne, no fulcro do axioma legal que norteia outra instituição de maior ambiência que é a ONU! Sim pois o estabelecimento do direito nato de autodeterminação e soberania das nações, independentemente de seu poder bélico e importância geopolitica, que faz veraz um sistema de igualdade jurídica entre os estados malgradas as desigualdades materiais dos povos, nações e estados nacionais. O parâmetro, relativizado pela prática histórica e as guerras, obtido através da chamada ” Paz da Vestfália”, um marco no direito internacional aquele novo sistema internacional que “ainda que não houvesse tornado a guerra ilegal, estabeleceu um conjunto de procedimentos que visava evitá-la a todo custo. Entre outras coisas, ficou acordado o recurso da diplomacia ao invés da guerra como solução para conflitos e a aclamação das noções de soberania do Estado (em negócios internos e externos) no lugar do princípio de intervenção. E como as nações representadas nas conferências de Münster e Osnabrück preocupavam-se com a emergência futura de uma potência hegemônica, isto é, uma potência que tivesse muito mais força que os demais entes políticos da região (que iam desde repúblicas até monarquias, passando por ducados e principados), consagrou-se a igualdade dos Estados soberanos, mesmo que estes não fossem semelhantes em termos militares ou de sistemas políticos. Todos teriam que, dali em diante, respeitar os territórios uns dos outros, assim como seus anseios, desde que, claro, não se colocasse outro território em risco iminente.4 Os Tratados de Vestfália, deste modo, consagraram a ideia de “múltiplas independências” no continente europeu, além de refletir a necessidade de um sistema de “balança de poder”.
Todas essas mudanças são consideradas por boa parte da literatura especializada como um divisor de águas na constituição do mundo moderno. Hoje, com a invasão pela Rússia de Putin contra a Ucrânia, mais do que um bloco monolitico da OTAN ( NATO) reage também a ONU de forma monolítica, ainda com a abstenção da China continental, mas já integrada racionalmente contra os chamados DIREITOS DE VETO que algumas potências, membros natos de seu Conselho de Segurança, detêm fazendo assim, com estas potências façam letra morta, bem assim, o Tratado das Nações Unidas. Hoje, com a invasão da Rússia contra a Ucrânia, este verdadeiro não direito DE VETO, pela reação unânime da Opinião Pública Mundial começar a ter seu horizonte de eventos pois é um daqueles paises privilegiados, que com seu direito de veto negam a IGUALDADE AURIDA PELO TRATADO DE PAZ DA VESTEFÁLIA, e sobrepõem-se contra a comunidade internacional das nações que, assim, pelo seu rechaço total, na expressão UM POR TODOS E TODOS POR UM colmata a NATO e a entidade mais cosmopolita, a ONU, para a necessidade absoluta dos valores em defesa da incolumidade das nações, estados, suas soberanias e também suas democracias, nos termos originários do TRATADO DE PAZ DA VESTFÁLIA, datado de 1648. Estamos portanto, no limiar do seculo XXI, frente ao momento de transicao, o por do sol do ” não direito de superpotencias com poder de dissuasão atômica de quererem permanecer como mais iguais entre os iguais mantendo seu DIREITO DE VETO dentro das Nações Unidas contra o bloco monolitico e em maioria das nações menos iguais entre os iguais! A lógica inaugurada pela barbárie de Putin contra o cerne, o fulcro, o núcleo duro do Direito Internacional das civilizações, que faz valer estre os estados os mesmos direitos juridicos, morais e éticos, das cidadanias, direitos inalienáveis dos seres humanos, que inauguram o Constitucinalismo e antes dele o Jusnaturalismo, hoje, pela citação de Jens Stoltenberg repizando a ficção imortal de Alexandre Dumas em seu Os Três Mosqueteiros, por força invencivelde lógica formal e mesmo de dialética racional, torna a igualdade material de todos os povos, malgrada a pobre Ukrania e seu povo inocente massacrados e invadidos por tropas de um autocrata antidemocrático que quer substituir um governo democráticos e instituir um governo militar a la Petáin, como fez Hitler na metade da França, instituindo um governo titere e colaboracionista contra as razões da nação francesa reafirmadas pela retomada do herói De Gaulle! Assim é que hoje, 27 de fevereiro de 2022, as palavras emblematicas e históricas de Jean Stoltenberg, à frente da Nato ( OTAN) UM POR TODOS E TODOS POR UM por imperativo de coerência logico formal, inexorável e inevitavelmente, levam à que por amor a coerência e a lógica as Nações Unidas passem, a partir desta data, a banir o DIREITO DE VETO DE QUALQUER SUPERPOTENCIA seja ela qual for tenha ou não tenha poder de dissuasão atômica ou não! Estamos assim frente a uma mudança de parâmetros ou paradigmas pois de relativos os princípios auridos na dita PAZ DA VESTFÁLIA os direitos de IGUALDADE entre os estados, nações e povos, passam a ser ABSOLUTOS pois não haverão mais estados mais iguais nem menos iguais possuindo todos, no seculo XXI, a ISONOMIA TOTAL E ABSOLUTA! Que o ser humano não lese a lógica com seus sofismas enganosos e que o direito da PURA E RETA RAZÃO impere sobre todos os povos!
